We recommend, irrespective of age, that all our clients have a will.
Wills
A properly drafted will enables you to decide who will inherit your estate, on what terms, who will be your executors and, if you have children, who will be their guardians. In addition, the way in which you leave your estate will have a major bearing on the level of taxation of your estate when you die.
At Humphrey & Co we can advise you on the most tax efficient ways of drafting your will and can arrange for the preparation of this and any other legal documentation required to give effect to your wishes.
Lasting powers of attorney
These were introduced as of 1 October 2007 replacing Enduring Powers of Attorney. (If you made an Enduring Power of Attorney before 1 October 2007 this will still be valid, if correctly executed, whether registered or not.)
There are two types of Lasting Power of Attorney:
Property and Affairs enabling attorney(s) to make financial and property decisions on behalf of the donor e.g. operating a bank account, selling property.
Personal Welfare enabling attorney(s) to make health and personal welfare decisions on behalf of the donor e.g. day to day care, medical treatment.
